Business Registration: Step by Step to Success


Once you have your idea, plan, and legal form in place, it’s time for the formal registration. This is the moment when your idea becomes an official business.


Requirements & Costs:


  • You must be at least 18 years old and registered as a resident in Germany.
  • Registration takes place at the local trade office (before starting operations).
  • Depending on the state, the cost ranges from €20 to €60.

Special considerations for activities requiring authorization or a license: Some industries require specific official authorizations, which must be demonstrated prior to registration.


  • License-required: e.g., itinerant trade, insurance advisors.
  • Authorization-required: e.g., taxi companies, restaurants, driving schools.
  • Skilled trades: For trades requiring certification, a master craftsman’s certificate or an equivalent qualification is often necessary.

Legal framework:


  • EU citizens: Can generally start a business in Germany without restrictions and are treated the same as German citizens.
  • Non-EU citizens: Require a valid residence permit that allows for self-employment.
  • Without registration: Anyone operating a business without registration is committing an administrative offense. This can result in fines of several thousand euros as well as back taxes.

The Registration Process


You can register online, in person, or by mail. The process typically involves the following steps:


  • Prepare documents: Gather all necessary documents (ID card/passport with proof of residence, articles of incorporation—if applicable—, certificates of qualification, criminal record check, and, if required, a medical certificate).
  • Submit the application: Submit the registration form to the Trade Licensing Office (online, by mail, or in person). Pay the fee and submit the documents. Once approved, your information will be automatically forwarded to the tax office, the Chamber of Industry and Commerce (IHK)/Chamber of Crafts (HWK), and the employers’ liability insurance association.
  • Tax registration questionnaire: Within one month of establishing your business, you must submit the questionnaire to the tax office. You will report your expected revenue and receive either a tax identification number (for small business owners) or, additionally, a VAT ID.

-Note: For services within the EU, you are required to have a VAT ID, even if you are a small business owner.

  • IHK/HWK registration form: As a business owner, you are a mandatory member. Fill out the registration form. If your profits are low, you often do not have to pay any fees.
  • Professional accident insurance association: These statutory accident insurance providers are responsible for occupational safety and health protection. The Trade Licensing Office will automatically register you, but you should check within one week of registration to ensure everything is correct.
  • Optional steps:

-If you plan to hire employees: Apply for a company number from the Federal Employment Agency (required for social security reporting).

-Registration in the Trade Register (if applicable).


Important Additional Information for Everyday Life


  • Change of Registration and Deregistration: A change of registration is required in the event of a change of location, name, or business activity. Deregistration is free of charge.
  • Commercial Register: For corporations (GmbH, AG) and certain sole proprietors, registration in the Commercial Register at the local court is mandatory. This often happens automatically after the notary appointment, but must be actively initiated.
  • Subcontractors: As a subcontractor, you are also required to register a business. A clear contract with the main company, particularly regarding liability, is essential.
