Traffic Laws in Germany Part 2

Fines, Points, and Driving Bans


Many drivers in Germany receive fines for speeding, using a cell phone while driving, or other traffic violations. Often, those affected do not know what rights they have or whether it is worth appealing.


The fine procedure in Germany


A fine procedure usually begins with a hearing form. This is followed by the official notice of the fine.


Important deadlines

  • An appeal against the notice can be filed within 14 days.
  • If no appeal is filed, the notice becomes final.
  • Failure to pay may result in reminders or further measures.

Many notices contain formal errors or inaccurate measurements. Therefore, a review may be worthwhile.


When is it worth appealing?


An appeal can be successful if:

  • the measurement was incorrect,
  • the speed camera photo is unclear,
  • the statute of limitations has expired,
  • or special circumstances exist.

The case should be reviewed, especially if a driving ban is imminent or if many points are at stake.


Speeding


Speeding is one of the most common traffic violations in Germany.


In built-up areas

  • Points can be imposed for exceeding the speed limit by as little as 21 km/h.
  • Higher speed violations can lead to driving bans.

Outside Built-Up Areas

Penalties also increase rapidly outside built-up areas—especially at high speeds.


In addition, measurement tolerances are taken into account. Errors in speed cameras or measuring devices occur more frequently than many people realize.


Driving Ban or License Revocation?


Many people confuse these two terms.


Driving ban

  • Temporary (usually 1–3 months)
  • Driver’s license must be surrendered temporarily

License revocation

  • Complete loss of driving privileges
  • New application required after the suspension period

In certain cases of hardship, a driving ban can be reduced or avoided.

Traffic violations are recorded in the Driver Fitness Registry in Flensburg.


Points and Consequences

  • 1–3 points: Recorded
  • 4–5 points: Warning
  • 6–7 points: Caution
  • 8 points: Revocation of driver’s license

Depending on the violation, points remain on record for several years.
