In Germany, every real estate purchase must be notarized by a notary. The notary reviews the purchase agreement, arranges for the entry in the land registry, and oversees the legal settlement of the purchase.
The notary appointment should not be scheduled until financing has been confirmed. Buyers typically receive the draft contract about two weeks in advance, allowing sufficient time for review.
The combined costs for the notary and the land registry amount to approximately 2% of the purchase price and are regulated by law.
After the signing, the notary handles all further legal steps. This includes, among other things, registering the priority notice of conveyance and verifying all necessary approvals.
Once all requirements have been met, the notary requests payment of the purchase price. After payment is made, the final transfer of ownership is recorded in the land registry.
